The Puritan Pure Food Company was a manufacturer of chocolate and cocoa products and had offices at 103 Park Avenue in New York.
In 1914, the company was sued by the Baker’s Chocolate for using a product label that basically mimicked Baker’s traditional design. Baker's cocoa and chocolate had long been identified by the familiar chocolate girl figure, as well as by the name "Baker". This had for years appeared on their packaging and was a ready means of visual identification. The product was very commonly called for by purchasers as "the chocolate with the picture of the woman," "the chocolate with the girl on it," "the chocolate with the picture of the lady".
The Puritan Pure Food Company put out a chocolate with the picture of a woman at the right of the label. Baker’s claimed that this would lead to people to confuse the Puritan and Baker’s products and allow Puritan to capitalize on "The chocolate with the girl or lady" term, a term that had long been designated to the Baker’s brand.
